MBBS/BDS Admissions 2024: High Court Ruling on Local Candidature Clears Hurdles for NEET Counselling

A two-judge panel of the Telangana High Court, consisting of Chief Justice Alok Aradhe and Justice J. Sreenivas Rao, issued a significant ruling concerning the local candidature criteria for admissions to medical and dental colleges in Telangana. The bench read down Rule 3(a) of the Telangana Medical & Dental Colleges Admission Rules, 2017, as amended by Government Order (G.O.) 33.

The bench, led by the Chief Justice, clarified that all locals are eligible under the local quota. The bench observed that there are no proper guidelines on who qualifies as a local. It directed the government to develop appropriate guidelines for determining local status. The High Court ruled that admissions should be granted based on these government guidelines. It also instructed Kaloji Narayana Rao Health University to grant admissions to students accordingly.

Key Points of the Ruling

  • Amendment Details: G.O. 33 required candidates to have either studied in Telangana for at least four consecutive years or resided in the state for at least four years before their intermediate exam to be considered local.
  • Challenge: This rule was contested by 53 writ petitions from candidates seeking admission to MBBS and BDS courses for the 2024-25 academic year.
  • Petitioners’ Argument: The petitioners argued that the rule unfairly classified them as non-local despite their significant educational ties to Telangana, citing reasons such as studying intermediate education in other states due to their parents’ government jobs.
  • Previous Ruling: The bench noted that a similar rule had been read down the previous year, allowing candidates with permanent resident certificates to be considered local.
  • Defense: Advocate General A. Sudarshan Reddy defended the amended rule, citing its validity and reasonableness, and referenced a Supreme Court judgment that upheld stricter rules in Assam.

After detailed hearings over three days, the bench read down Rule 3(a) of the Telangana Medical & Dental Colleges Admission Rules, 2017, as amended by G.O. 33. The new order allows candidates to submit a permanent residence certificate to be classified as local candidates.
